*Current process for resolving disputes or allegations of misconduct: After working with both attorneys to address the problem, the ombudsman will issue a confidential (internal to the attorneys involved and the CCFLA Board) report, indicating whether the issue was resolved or not. “Resolution” refers not to the substance of cases but only to complaints regarding process/conflict between attorneys. If not resolved, the CCFLA Board will take the matter up as a Complaint. Should a Board member be named in a Complaint, the Board will appoint a committee of at least 5 CCFLA non-Board roster members to serve as the deciding body regarding that Complaint. The Board will either issue a warning to one or both of the attorneys involved or take no action, based on the recommendation(s) of the committee. Any CCFLA member receiving three warnings from the Board will be suspended from the CCFLA. If a CCFLA member disputes such suspension, he or she may submit a letter of appeal. The appeal will be submitted to a local arbitrator selected by the CCFLA, and the decision of the arbitrator will be binding on both the CCFLA and the member who submitted the appeal. Fees for arbitration will be split equally between the CCFLA and the appealing member, subject to reallocation by the arbitrator.
